Workers' Compensation Bureau

 

The Workers’ Compensation Bureau assists the Superintendent administrating and enforcing New Mexico laws regarding workers’ compensation coverage written through insurance companies.  Specifically, the Bureau focuses on responding to questions and complaints from employers relating to workers’ compensation payroll audits, experience modifiers, job classifications, and premium determinations.  The Bureau also approves employee Safety Bonus Programs, supervises the Assigned Risk Pool and works with the Workers’ Compensation Appeal Board.  Please refer the NM statues and NMAC for more information on the topics listed below.

Workers’ Compensation Insurance Contracts and Assigned Risk Pool.
NM Insurance Code 59A-33-3
Purpose:
It is the purpose of the Workers’ Compensation Assigned Risk Pool Law to provide for the insurance of workers’ compensation insurance risks that have, in good faith but without success, sought insurance in the usual manner from any two or more insurers authorized to transact in New Mexico the business of workers’ compensation insurance and to provide for the equitable distribution of risks among commercial line insurers.

Workers’ Compensation Appeals Board.
NMAC 13.17.2.2
Scope:
The rule applies to grievances relating to experience modification factors, classifications assignments and manual rules which are to be heard by the New Mexico Workers’ Compensation Appeals Board.

NMAC 13.17.2.6
Objective:
The purpose of this rule is to establish a Workers’ Compensation Appeals Board to provide a mechanism by which parties may obtain review of the application of the rules of the workers’ compensation system to their individual workers’ compensation policies.

 

52-1-6.2
Safety Programs-Inspection-Penalties-Bonuses.
Purpose:
Any employer who is subject to the provisions of the Worker’s Compensation Act may implement a safety program, as approved by the Superintendent of Insurance, that provides for bonuses of up to ten percent of the worker’s wage paid to a worker who fulfills the criteria established by the employer for eligibility for the bonus.
