Service of Process Instructions

If the Insurance Company is doing business in New Mexico, then the Service of Process is done by the Superintendent of Insurance.

If you have an inquiry on if the company is doing business in New Mexico, please call Rose Anne at 505-827-1291.

1. We need two (2) copies of every document (summons, complaint, etc.). The only time when we need three (3) copies is when there is a Subpoena or Subpoena Dues Tecum.

Summons and Subpoenas must read:

TO: Name of Insurance Company
C/O NM Superintendent of Insurance or
C/O John G. Franchini, Superintendent of Insurance

2. A check for $20 is to be made out to the New Mexico Public Regulation Commission (Insurance Division). We accept business and personal checks, and money orders. Cash is not accepted.

3. A self-addressed stamped envelope (letter size envelope and 45 cent stamp) to return your Certificate of Acceptance of Service.

4. If the proper number of copies are not sent, a $1 per page will be charged, or your package will be returned.

5. If you do not send a check, your package will be returned.
