1. ADMINISTRATIVE SERVICES DIVISION

(a) Corporations Bureau (827-4508)

i) Processes all incoming documents to ensure compliance with state statutes for Domestic and Foreign Corporations, Profit/Non-Profit, and Limited Liability Companies

ii) Processes certified copies of documents, corporate name reservations and registrations, and the processing of Annual & Bi-Annual reports for corporations

(1) Processes suspension of business and reinstatement notices for reporting purposes, and issues licenses to Cooperatives

(b) Financial Management Bureau (827-4084)

i) Responsible for the upkeep and administration for the general finances of the PRC. This includes:

(1) Purchasing, execution of professional services and leases, contracts, accounts payable, revenue depositing and posting, and the general ledger upkeep budgeting and fixed assets accountability

(2) Procuring and overseeing agency audits

(3) Repair and maintenance of equipment, distribution of parking cards for Marian Hall, follow up of repairs with PERA Building maintenance, administering of PRC fleet (vehicle) gasoline cards, fleet emergencies, and any other miscellaneous agency issues that cannot be handled within other divisions or bureaus of the PRC

(c) Human Resource Bureau (827-4084)

i) Provides services to PRC Employees in Personnel/Payroll Record Management, Workers Compensation, Leave Administration, and Benefits

(d) Information Systems Bureau (827-6983)

i) Responsible for day-to-day computer operations of the PRC

i.) Maintains both active and inactive case records of the Utility (electric, gas, water, and telecommunications) Legal (827-6968), and Transportation Division (827-4526)

2. CONSUMER RELATIONS DIVISION (827-4592)

a) Educates the public about PRC rules, procedures and programs applicable to regulated Insurance and Utility (electric, gas, water, sewer, and telecommunications) companies

b) Processes complaints regarding utility and insurance matters and provides assistance to consumers who have been unable to reach resolution

3. GENERAL COUNSEL’S OFFICE (827-6947)

a) Advises the Commissioners on all legal matters arising from the Commission’s regulatory responsibilities

i) Administers formal proceedings before the Commission; assists the Commission in its deliberations on those proceedings, and drafts orders, resolutions and other decisions issued by the Commission

i) Defends Commission decisions that have been challenged in State and Federal Court

4. HEARING EXAMINERS (827-6956)

a) The Hearing Examiners function as judges in the cases assigned to them. They set hearings and conferences, establish procedures and details for the conduct of proceedings, ensure that a full and adequate record is established, make rulings on procedural and evidentiary matters, conduct hearings, admit evidence into the record, analyze evidence, briefs and applicable laws, rules and orders, certify stipulations negotiated by parties to the Commission, and make recommended decisions to the Commission, including findings of fact, conclusions of law and ordering paragraphs.

5. INSURANCE DIVISION (827-4601)

a) Examinations Bureau (827-4390)
Conducts on-site examination of the financial condition, affairs, books and records of all domestic insurance companies, health maintenance organizations, and dental companies licensed in New Mexico to determine solvency, general business practices, market conduct of business and treatment of policy holders (members & subscribers)

b) Insurance Fraud Bureau (476-0560)
Investigates, detects and prosecutes insurance fraud cases while working with state, local, and federal law enforcement and regulatory agencies

c) Investigations Bureau (827-4439)
Investigates inquiries concerning agent and company conduct and reports any code violations for administrative and enforcement action

d) Licensing and Revenue Bureau (827-5781)

i) Revenue Processing Unit

(1) Processes all revenues in the Insurance Division

(2) Audits and tracks all revenue batches before they are submitted to the Accounting Bureau for deposit at the State Treasurer’s Office; after the Accounting Bureau validates the batches they are returned to this unit for confirmation, then returned to the submitting sections

ii) Company Licensing Section (827-4547)

(1) This section reviews pending applications for insurance companies, surplus lines insurers, HMOs, Non-profit Health Care Plans, Prepaid Dental, Mexican Casualty Insurers, Lloyds Plan Auto, Title, Fraternal Benefit Societies, Insurance Premium Finance Companies, Rate Service Organizations, Advisory Organizations, Motor Clubs, and Service Contract Providers. All structural changes for companies licensed with our section are reviewed for compliance.

This includes name changes, redomestications, demutualizations, acquisitions, mergers, address changes, officer/director changes, and Insurance Holding Registration Statements for foreign insurers. Section also reviews Sale of Securities documentation, and is responsible for renewal of insurance company Certificates of Authority every March 1st and every May 1st (for Insurance Premium Finance Companies and Rate Service Organizations respectively).

(2) Section is responsible for the maintaining of insurance company deposits. The deposits consist of eligible securities or surety bonds. The securities are maintained with our custodial bank and the surety bonds are maintained at the State Treasurer’s Office.

iii) Unauthorized Insurers Unit

(1) Unit is responsible for the review of pending applications for Risk Retention Groups, Purchasing Groups, and Surplus Line Brokers. Receives premium tax monies collected from the Surplus Line Brokers, and reviews the policy filings. Responsible for the renewal of Surplus Line Broker Licenses, and annual registration of Risk Retention Groups and Purchasing Groups.

iv) Agents’ Licensing Section (827-4537)

(1) Responsible for reviewing applications, collecting fees and processing licenses for approximately 57,000 Agents, Solicitors, Bail bond Agents, Non-Resident Agents and Brokers, Independent, Staff and Public Adjusters, Third Party Administrators, Corporations, Proprietorships and Partnerships, Managing General Agents, Reinsurance Intermediary Brokers and Managers, Vending Machines and Motor Club Representatives

(2) Enforces Continuing Education requirements that apply to all licensed Resident Agents, Brokers and Solicitors

(v) Revenue Audit Section (827-5781)

(1) Collects and receives monies from the insurance companies on premium taxes and policy filing fees; all insurers authorized to transact insurance in New Mexico and each property bondsman, self insured company, title company, risk retention group, and select purchasing group is subject to premium tax on a quarterly basis

(2) Section collects the annual fraud assessment fees and annual statement filing fees

(3) Section audits and ensures compliance on all the final and quarterly tax returns for all insurance companies including bail bondsmen

(e) Life and Health Bureau (827-4555)

i) Analyzes all life and health policy forms and rates submitted, such as Life and Annuity Insurance, Group Life and Annuity Insurance, Pre-arranged Funeral Plans, Credit Life and Disability Insurance, Health, Accident and Franchise Insurance, Group Health and Accident Insurance, Small Group Rate Renewability, Managed Health Care Plans, Health Maintenance Organizations (HMO), New Mexico Health Alliance, Fraternal Benefit Societies, Non-Profit health & Accident Insurance, New Mexico Comprehensive Health Insurance Pool (CHIP), Medicare Supplement Plans, Medicare Supplement Premium Refund Calculations, Long-Term Care Insurance, and Prepaid Dental Insurance.

(f) Managed Health Care Bureau (827-3928)

i) Insures that consumers and providers are afforded rights under the NM Insurance Code, the Managed Health Care Rule, the Grievance Rule and the Patient Protection Act

(1) Initiates investigations into cases that may be in violation of established laws and regulations

(2) Reviews and approves compliance plans, such as access to health care services, cultural and linguistic diversity, provider grievance plan, and annual reports

(3) Develops and performs outreach presentations throughout the state of New Mexico

(g) Property and Casualty Bureau (827-4580)

i) Reviews rate, rule and form filings from all property and casualty insurance carriers licensed in New Mexico; this includes Automobile, Motorcycle, Motor Home, Motor Clubs, and Boat Insurance, as well as Fire and Extended Coverage, Homeowners, Burglary, Glass, Surety and Fidelity and General Liability Insurance

(h) Title Insurance Bureau (827-4381)

i) Provides protection for the consumers and purchasers of title insurance policies, and assures the financial stability of the insurance industry in New Mexico, through ratemaking and rule promulgation

ii) Enforces rules and addresses general complaints from the public concerning title insurance matters

(i) Workers’ Compensation Bureau (827-4652)

i) Designs and implements the New Mexico Workers’ Compensation Assigned Risk Pool, which provides workers’ compensation coverage for employers who do not qualify for voluntary market coverage

ii) Regulates and assists industries affected by workers’ compensation, and works directly with executives to promote loss control measures with emphasis on accident prevention and work place safety

iii) Investigates and regulates insurance companies to assure a healthy market and adequate workers’ compensation coverage for employees insured through the voluntary market

iv) Serves as an advocate for consumers on all workers’ compensation-related complaints received by the Insurance Division.

6. LEGAL DIVISION (827-6969, 827-4818)

a) Provides legal advice and representation to the staff of the Utility Division (including telecommunication, gas, water, electric, and wastewater), Administrative Services Division, Consumer Relations Division, Insurance Division (including State Fire Marshal), and the Transportation Division (including Pipeline Safety)

b) Represents Staff in proceedings before the Commission or the Insurance Superintendent, provides advice to Staff regarding questions of regulatory compliance, and assists Staff in enforcing relevant statutes and regulations

7. STATE FIRE MARSHAL’S DIVISION (1-888-4ASKPRC or 1-888-427-5772)
       (a) Responsible for arson investigations and inspections

(1) Investigates arson and explosions

(2) Inspection/Code Enforcement is responsible for life safety, above ground storage tanks, fireworks, system and fire prevention

ii) Responsible for administration and distribution of fire funds

        (b) NM Firefighters’ Training Academy Bureau
              (837-7500 &1-800-734-6553, Socorro)

i) Meets the needs of a complex and dynamic fire service by providing firefighting-training programs of the highest quality

(1) Objective is to develop the basic and advanced skills necessary for emergency responders to best serve the citizens and guests of New Mexico

 

8. TRANSPORTATION DIVISION (827-4519)

(a) Applications Section

Section processes all applications for Warrant Authority, which includes general commodity haulers (gravel haulers), vehicle escort services, transportation of cadavers, hazardous materials, vanpools, charter bus services (tour) and towing services. Monitors all warrant holders to insure compliance.

i) Manages the Unified Carrier Registration System monitoring motor carriers who transport for-hire on an interstate basis

ii) Insures that all registered Motor Carriers are in full compliance with Federal Motor Carrier Act requirements; collects and accounts for registration fees, and distributes fees to the agency and participating states

(b) Compliance Bureau

i) Responsible for enforcing the provisions of the New Mexico Motor Carrier Act, and the New Mexico State Corporation Commission, Motor Transportation and Ambulance and Medical Rescue Service rules

ii) Processes applications for Certificate of Public Convenience and Necessity and Motor Carrier permits

iii) Investigates complaints brought against motor carriers who have received a Certificate of Public Convenience and Necessity, or a Permit, for taxi, limousine, shuttle service, tour and sightseeing service, vanpools and ambulance service, etc.

iv) Conducts periodic audits of these entities regarding business records, vehicle safety, insurance requirements and tariffs

v) Responsible for motor carriers that have received Warrant Authority from the Commission such as general commodity haulers (gravel haulers), vehicle escort service, transportation of cadavers, hazardous materials, vanpools, charter bus services (tour) and towing services

vi) Investigates complaints brought against these types of motor carriers and conducts periodic audits regarding business records, vehicle safety, insurance requirements and tariffs

vii) Conducts periodic safety inspections of Railroad Crossings and Operation practices. On call investigations of accidents occurring in the two previously mentioned areas are also the responsibility of this bureau.

(c) Pipeline Safety Bureau (476-0298)

i) Performs safety and compliance inspections of intrastate gas and liquid pipeline facilities, including transmission, distribution, gathering and master meter pipeline facilities

ii) Issues pipeline license applications and collects license fees from pipeline companies

iii) Enforces alleged damage to underground utility lines such as water, gas, telecommunications and electric lines

9. UTILITY DIVISION (827-6940)

Serves as staff to the Commission in the regulation of electric, natural gas, renewable energy resources, telecommunications, and water and wastewater systems. Represents the public interest in utility matters before the Commission. Makes presentations to the Commission in the form of testimony and exhibits to ensure that adequate utility and telecommunications services are provided at fair, just and reasonable rates.

(a) Accounting Bureau

i) Evaluates accounting procedures utilized by companies and submits recommendations and advises the Commission on the implications of new accounting releases and standards

(b) Economics Bureau

i) Conducts economic and financial market analysis for all utilities

ii) Provides cost of capital and financial market issues including general economic issues

(c) Electrical Engineering Bureau

i) Performs analysis and provides expert testimony on issues related to electric utility companies, including plant design, specifications, capacity, reliability, depreciation rates, utility expenses and certificates of public convenience and necessity

(d) Gas, Water and Wastewater Engineering Bureau

i) Performs analysis and provides expert testimony on issues related to natural gas, water and wastewater utilities, including plant design, specifications, capacity, reliability, depreciation rates, utility expenses and certificates of public convenience and necessity

(e) Telecommunications Bureau

i) Performs analysis and provides expert testimony on issues related to telecommunications, including rulemakings and cases before the Commission
